Nytout Inc. ("Nytout," "we," "us," or "our") operates a nightlife event ticketing platform available in Canada, excluding Quebec. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use our website, mobile app, and related services.

This Policy applies to patrons, event organizers, venue staff, and other users of Nytout. Nytout is intended only for users who are 18 years of age or older.

2. Information We Collect

  • Account information: name, email address, profile information, authentication identifiers, and account status.
  • Age-gating information: date of birth or age-related information used to determine eligibility for age-restricted events.
  • Ticket and order information: event purchases, ticket details, order history, service fees, refunds, cancellations, and admission status.
  • Payment information: payment processing details handled by our payment providers. Nytout does not store full payment card numbers.
  • Location information: precise location only when you enable location-based features in the app.
  • Camera access: camera access may be used by authorized event or venue staff to scan tickets. Nytout does not use camera access for general photo or video collection.
  • Device and app information: device identifiers, app version, operating system, IP address, browser type, log data, and push notification registration identifiers.
  • Communications: messages you send to support or communications related to your account, orders, events, or service issues.
  • Analytics information: basic analytics about how users interact with Nytout, such as page views, performance, and usage trends.

3. How We Use Personal Information

We do not use push notifications for marketing unless we separately ask for and receive the required consent.

  • Create and manage user accounts.
  • Verify eligibility for age-restricted nightlife events.
  • Process ticket purchases, service fees, refunds, and order records.
  • Provide tickets and support event admission.
  • Send transactional and service messages, including ticket updates, order confirmations, event reminders, refund notices, and security alerts.
  • Register devices for push notifications when enabled.

4. Consent

By using Nytout, you consent to the collection, use, and disclosure of personal information as described in this Policy. Some features, such as precise location, camera access, and push notifications, require device-level permission and can be disabled in your device settings.

If you withdraw consent for information required to provide the service, we may not be able to provide certain features.

5. How We Share Information

We do not sell personal information.

  • Payment processors, including Stripe, to process payments, refunds, taxes, fraud checks, and related financial services.
  • Authentication providers, including Clerk, to manage login and account security.
  • Database, hosting, and infrastructure providers, including Supabase and Vercel, to operate the platform.
  • Event organizers and venue staff, where necessary to validate tickets, manage admission, enforce event rules, or administer organizer refund policies.
  • Service providers, such as analytics, email, infrastructure, security, and support vendors.
  • Legal or regulatory authorities, where required by law or necessary to protect rights, safety, users, or the platform.

6. Event Organizers and Admission

When you purchase a ticket, relevant ticket and order information may be made available to the organizer or authorized venue staff for event operations, admission, and refund administration. Organizers are responsible for their own conduct and handling of information they receive outside Nytout.

7. Cookies and Analytics

We use cookies and similar technologies for login, checkout, security, preferences, and basic analytics. More information is available in our Cookie Policy.

8. Retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy, including account management, ticket records, payment records, fraud prevention, tax/accounting obligations, dispute resolution, and legal compliance.

We use administrative, technical, and organizational safeguards designed to protect personal information against loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. No system can be guaranteed completely secure.
